These Terms of Service ("Terms") govern your access to and use of Shapenly (the "Service"), operated by Istin Journey Companions LLC ("Estin," "we," "us," or "our"), a Virginia limited liability company. By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
Shapenly is a certification preparation and fieldwork management platform designed for individuals pursuing BCBA or BCaBA certification through the Behavior Analyst Certification Board (BACB). The Service includes fieldwork hour tracking, study tools, AI-powered practice scenarios, mock exams, supervision management features, and post-certification resources.
2. Accounts
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep your profile information current.
You must be at least 18 years old to create an account. Accounts are for individual use only and may not be shared with others.
3. Subscription Plans and Billing
Shapenly offers a free tier and paid subscription plans (Plus and Pro). Paid subscriptions are billed monthly or annually through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through the billing section of your account settings. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial billing periods.
We reserve the right to change pricing with 30 days' notice to active subscribers. Price changes will not affect your current billing period.
4. AI-Powered Features Disclaimer
Important: AI features are for educational practice only.
AI scenario practice, mock exam questions, study drill content, and adaptive learning features are generated by artificial intelligence for educational and practice purposes only. This content does not replace actual supervision, clinical judgment, or constitute clinical, ethical, or professional advice. Always consult with your supervisor for guidance on real clinical situations. We do not guarantee the accuracy, completeness, or clinical appropriateness of any AI-generated content.
5. Fieldwork Data Accuracy
You are solely responsible for the accuracy of all fieldwork hours, supervision data, and verification records you enter into Shapenly. The Service provides tools for tracking and organizing this information, but it does not verify the accuracy of your entries. Falsifying fieldwork data may violate BACB ethics standards and is grounds for immediate account termination.
Shapenly is not affiliated with, endorsed by, or officially connected to the BACB. We align our features with publicly available BACB requirements, but you are responsible for confirming current requirements with the BACB directly.
6. Supervisor Connections
When you share your invite code with a supervisor, you grant that supervisor access to view your fieldwork hours, task list progress, supervision agendas, and scenario completion records. Scenario transcripts require your separate, explicit approval before a supervisor can view them. You may disconnect from a supervisor at any time through your Settings.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false or misleading information, including fabricated fieldwork data
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Use the Service to distribute spam, malware, or harmful content
- Share your account credentials with any other person
- Use AI-generated content (scenarios, exam questions, feedback) as the basis for real clinical decisions
8. Intellectual Property
All content, design, code, and features of Shapenly are the property of Istin Journey Companions LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.
Content you enter into the platform (fieldwork entries, notes, custom scenarios) remains your property. By submitting custom scenarios that are promoted to the community library, you grant us a non-exclusive license to display that content anonymously to other users.
9. Limitation of Liability
To the maximum extent permitted by law, Istin Journey Companions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes but is not limited to damages related to lost fieldwork data, incorrect compliance calculations, AI-generated content accuracy, exam outcomes, or certification decisions.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
11. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service will cease. We will retain your data in accordance with our Privacy Policy and BACB-aligned retention requirements.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Virginia.
